Demurrage and Detention Rules

Dear Valued Customer:

King Ocean updates their Demurrage and Detention Rules
Effective January 3, 2021:

FREE TIME
IMPORT SHIPMENTS (USE OF EQUIPMENT INTO THE U.S.):

1. Demurrage – Equipment held within Carriers Terminal Facility:
Free Time:
Dry Equipment, Refrigerated Equipment, Specialized Equipment: 3 Working Days
Applicable on Running Refrigerated Equipment also see Energy Charge applicable in addition to Demurrage

2. Detention – Equipment Held Outside Carriers Terminal Facility:
Free Time:
Dry Equipment – 4 working days
Refrigerated and Specialized Equipment – 2 working days

EXPORT SHIPMENTS (USE OF EQUIPMENT FROM THE U.S.)

1. Demurrage – Equipment held within Carrier’s Terminal Facility)
Free Time:
Dry Equipment 5 working days
For Shipments Destined to Peru and Ecuador the Free Time shall be 10 Working Days
Refrigerated and Specialized Equipment – 3 working days
Applicable on Running Refrigerated Equipment also see Energy Charge applicable in addition to Demurrage

2. Detention – Equipment Held Outside Carriers Terminal Facility:
Free Time:
Dry Equipment: 5 Working Days
Refrigerated/Specialized Equipment: 2 Working Days

Exception: For Shipments destined to the Caribbean the Free Time shall be 5 Working Days

EQUIPMENT USE CHARGES (PER DIEM)

Per Diem schedule applicable for Merchant Haulage and Carrier Haulage (applicable for Imports or Exports).

Equipment Charge
Dry Containers $110.00 per day or fraction thereof
Dry container with Chassis $135.00 per day or fraction thereof
Refrigerated (Temperature Controlled) Containers $250.00 per day or fraction thereof
Refrigerated (Temperature Controlled) Containers with Chassis $275.00 per day or fraction thereof
Flatracks, Open Tops or Tank Equipment $250.00 per day or fraction thereof
Flatracks, Open Tops or Tank Equipment with Chassis $275.00 per day or fraction thereof

Free Time on US shipments of Wearing Apparel and Clothing Cut-Outs shall be:

  • Northbound (Imports to the US) ten (10) calendar days combined demurrage and detention free time.
  • Southbound (Exports from the US) twelve (12) calendar days combined demurrage and detention free time.

Energy Charges shall apply per Tariff Rule and are calculated and charged independent of Demurrage Charges

In the event the equipment has not been returned empty within thirty (30) Calendar Days, The Carrier will have the right to retrieve the equipment, whether loaded or unloaded. Carrier shall provide Shipper as well as appropriate Governmental Authorities advance notice before taking such action. In such situations, all additional expense incurred such as Trucking, Handling, Detention/Demurrage Charges, Storage or Disposal of Cargo will be for the account of the Cargo.

Payment for all charges is due upon presentation of Invoices for Charges accrued. Payment shall be collected by the Carrier or its Authorized Agent.

Carrier shall refuse delivery of any Equipment held in its possession, which has accrued Detention/Demurrage Charges for a period in excess of Thirty (30) Days until such Charges have been paid. Should Account wish to receive the Cargo at the Carrier’s Terminal Facility, the applicable Handling Rate will apply in addition to all other Rates and Charges.

Carrier will decline to furnish new equipment to a Shipper who is holding other Carrier Equipment beyond the Free Time and accrued Per Diem Charges have not been paid.
